1. Acceptance of These Terms
These Terms of Use and Online Store Terms (the “Terms”) are a binding agreement between you and Advanced Dermatology and Aesthetic Medicine, LLC (“Advanced Dermatology,” the “Practice,” “Company,” “we,” “us,” or “our”). They govern your access to and use of our medical-practice website, WordPress pages, Shopify-powered storefront, online content, forms, accounts, shopping features, and other pages or services that link to these Terms (collectively, the “Website”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms govern the Website and online store. They do not replace informed-consent documents, financial policies, appointment policies, treatment agreements, or other documents governing professional medical services. Our Website Privacy Policy governs personal information collected through the public Website and store. Our Notice of Privacy Practices governs protected health information subject to HIPAA. More specific terms presented with a product, service, promotion, appointment, treatment, or transaction also apply; if those terms conflict with these Terms, the more specific terms control for that subject.
2. About the Website
The Website provides information about dermatologic conditions, treatments, procedures, providers, practice operations, and related topics. It also allows users to browse and purchase skincare products and, in some cases, treatment packages, services, or gift items through a Shopify-powered storefront.
The Website may provide links to appointment scheduling, the patient portal, online bill payment, social media, product manufacturers, and other third-party services. Those services may be operated by parties other than Advanced Dermatology and are subject to their own terms and privacy practices.
We may change, suspend, or discontinue any Website feature or item offered through the online store at any time, subject to applicable law and our obligations for orders we have accepted.
3. Medical and Educational Content
Website content may include articles, blog posts, photographs, videos, graphics, frequently asked questions, descriptions of conditions and treatments, product information, and other educational materials. This content:

4. No Physician-Patient Relationship
Your use of the Website does not, by itself, establish a physician-patient or other provider-patient relationship with the Practice or any clinician appearing on the Website. This includes:
- Reading or downloading Website content.
- Submitting a general contact or inquiry form.
- Sending an email or social-media message.
- Subscribing to communications.
- Purchasing a skincare product, treatment package, or other item.
- Requesting or scheduling an appointment through the Website or a third-party platform.
- Receiving an automated response, appointment confirmation, or general information from the Practice.
A professional relationship is established only through an appropriate clinical process after the Practice accepts you for care and a licensed healthcare professional undertakes to evaluate or treat you. Scheduling an appointment does not guarantee that a particular treatment will be recommended or performed.
If you are already a patient, these Terms do not alter the professional duties associated with care the Practice has agreed to provide. Public Website content is not a substitute for individualized instructions from your treating clinician.
5. Telehealth
Information on the Website and ordinary electronic communications do not constitute telehealth services. Telehealth care is provided only through a separately scheduled clinical encounter using processes approved by the Practice and is subject to applicable consent requirements, professional standards, privacy requirements, and geographic limitations.
The availability of telehealth does not mean it is appropriate for every condition or every patient. A clinician may require an in-person examination, testing, photographs submitted through an approved secure process, or referral to another provider.
6. Before-and-After Images, Testimonials, and Results
Before-and-after images, patient stories, testimonials, reviews, and descriptions of outcomes reflect individual experiences. They are provided for illustrative and informational purposes and are not promises, guarantees, or representations that you will achieve the same or similar result.
Results vary from person to person and may depend on many factors, including the condition being treated, skin type, age, health history, medications, anatomy, treatment selected, number and timing of treatments, adherence to aftercare, and individual response. Complications, side effects, incomplete improvement, recurrence, or the need for additional treatment may occur.
Testimonials and reviews express the experiences or opinions of the individuals who provided them. They are not medical evidence and should not be relied upon to decide whether a treatment or product is appropriate for you. Any disclosures displayed next to a specific image, testimonial, promotion, treatment, or product are incorporated into these Terms.
7. Skincare Products and Product Information
Product descriptions, ingredient information, instructions, reviews, and other retail content are provided for general shopping and educational purposes. They are not individualized medical advice. A product that is appropriate for one person may not be appropriate for another.
Before using a product, read and follow its label, ingredients, instructions, warnings, expiration information, and manufacturer guidance. Consult a qualified healthcare professional before use if you have a medical condition, allergies or sensitivities, are pregnant or nursing, take medications, use other active skincare products, or are uncertain whether a product is appropriate for you. Stop using a product and seek appropriate care if you experience a concerning reaction.
Unless expressly and lawfully stated, we do not represent that a cosmetic or skincare product will diagnose, treat, cure, or prevent a disease. Product results vary, and we do not guarantee a particular result.
Product photographs are illustrative. Packaging, labeling, color, texture, ingredients, manufacturer specifications, or appearance may change, and screen settings may affect how colors appear. Always rely on the labeling delivered with the product.
8. Online Orders and Terms of Sale
By placing an order, you represent that:
- You are legally capable of entering into a binding contract or are acting with the authorization of a parent or legal guardian.
- The billing, payment, shipping, and contact information you provide is current, complete, and accurate.
- You are authorized to use the payment method submitted.
- Your purchase is for lawful personal use and not for unauthorized resale or distribution.
An order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it. We may reject, limit, or cancel an order for reasons including product unavailability, suspected fraud, pricing or description errors, payment issues, shipping restrictions, or suspected unauthorized resale. If we cancel an order after payment has been processed, we will issue any refund required by applicable law and the applicable payment or refund policy.
Prices, promotions, product availability, shipping charges, and taxes may change without notice before an order is accepted. We may correct typographical, pricing, inventory, or other errors and may cancel affected orders as permitted by law.
All sales are final. We do not offer standard refunds or exchanges, although we may make exceptions on a case-by-case basis at our sole discretion and as required by applicable law. Any exception does not create an ongoing obligation to offer refunds or exchanges. Product-specific terms and manufacturer warranties, if any, also apply.
9. Treatment Packages, Services, and Gift Items Sold Online
The online store may offer treatment packages, services, promotional certificates, gift cards, or similar items. Purchasing one of these items does not establish medical candidacy, guarantee that the service will be medically appropriate, or require a clinician to perform a requested treatment.
Clinical services remain subject to an appropriate consultation or evaluation, informed consent, safety considerations, contraindications, provider availability, and Practice policies. Additional terms presented at the time of purchase—including expiration, transferability, cancellation, redemption, promotional, and no-show terms—also apply, subject to applicable law.
Store purchases are separate from insurance-covered medical services unless the Practice expressly states otherwise. Cosmetic services and retail products may not be covered by health insurance.
10. Appointments, Cancellations, and Insurance Information
An appointment request is not confirmed until you receive confirmation from the Practice or its authorized scheduling provider. Appointment availability may change, and the Practice may reschedule or cancel appointments when reasonably necessary.
You are responsible for complying with cancellation, rescheduling, deposit, and no-show policies communicated by the Practice. Nothing on the Website guarantees that a particular clinician, appointment time, treatment, or service will be available.
Insurance information on the Website is general and may change. A statement that the Practice accepts or participates with an insurance plan does not guarantee coverage, benefits, payment, medical necessity, prior authorization, or a particular out-of-pocket cost. You are responsible for confirming benefits and coverage with your insurer and for amounts assigned to you under your plan and Practice policies.
11. Patient Portal, Scheduling, and Other Third-Party Services
The Website may link to or integrate with third-party services, including Zocdoc, MyPatientVisit, Shopify, payment processors, shipping providers, social-media platforms, and other vendors. Your use of a third-party service is governed by that provider’s terms, privacy policy, and security practices in addition to any applicable Practice policies.
We do not control the availability, functionality, content, or security of independent third-party services. A link or integration does not mean that we guarantee every aspect of that service. This provision does not limit the Practice’s responsibilities under HIPAA or other applicable law for vendors acting on its behalf.
Use the secure patient portal or another method approved by the Practice for patient-specific clinical communications, medical records, and other sensitive health information. General Website forms and email are not intended for detailed medical information, photographs of a condition, account credentials, payment-card information, or urgent concerns.
12. Accounts and Account Security
Some Website or store features may require an account. You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account. Use accurate information, choose a strong password, and notify the relevant platform or the Practice promptly if you suspect unauthorized access.
Do not access another person’s account without authorization or attempt to bypass authentication or security controls.
13. Permitted Use and Prohibited Conduct
We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for lawful personal, noncommercial purposes in accordance with these Terms.
You may not:

- Use Website content to provide medical advice, impersonate a clinician, or suggest that the Practice endorses an unaffiliated product, service, or person.
- Use the Website to harass, threaten, defame, or infringe the rights of others.
We may restrict or terminate Website access for conduct that violates these Terms or threatens the Website, the Practice, or other users.
14. Intellectual Property
The Website and its content—including text, photographs, before-and-after images, graphics, logos, videos, design, software, product names, and other materials—are owned by or licensed to the Practice and are protected by intellectual-property laws.
You may view and print reasonable portions of the Website for personal, noncommercial use, provided that you do not remove notices or alter the content. No other right or license is granted. The names, logos, and marks of Advanced Dermatology and Aesthetic Medicine, LLC may not be used without prior written permission.
Third-party names, marks, images, and content remain the property of their respective owners.
15. Communications and Feedback
When you provide contact information, we may use it to respond to your inquiry, administer an appointment request or order, provide service-related notices, or otherwise communicate as described in our Privacy Policy and permitted by law. Promotional communications, if offered, are subject to applicable consent and opt-out requirements.
If you opt in to receive text messages from us, you consent to receive recurring automated marketing and informational text messages at the mobile number you provide. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP, and you may reply HELP for help.
Do not submit confidential business information, unsolicited commercial proposals, or content that infringes another person’s rights. If you voluntarily provide nonconfidential suggestions or feedback about the Website or store, we may use that feedback without restriction or compensation, provided that we handle personal information in accordance with our Privacy Policy and PHI in accordance with our Notice of Privacy Practices and applicable law.
User Content. The Website or online store may allow you to submit reviews, ratings, images, comments, or other content (“User Content”). You are responsible for your User Content and represent that you have the rights necessary to submit it and that it does not violate law or the rights of others. You grant the Practice a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, and distribute your User Content in connection with operating and promoting the Website and store. We may remove User Content at any time.
Prohibited User Content. You may not submit User Content that is unlawful, infringing, defamatory, harassing, obscene, or misleading, that impersonates another person, that contains another person’s private or health information without authorization, or that consists of a fake or incentivized review provided without the required disclosures.
Copyright Complaints. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. If you believe content on the Website infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent at info@advanceddermchi.com. We may remove allegedly infringing material and terminate the accounts of repeat infringers in appropriate circumstances.
16. Privacy and Health Information
Our Website Privacy Policy explains how we collect, use, and disclose personal information through the public Website and online store. Our Notice of Privacy Practices explains how the Practice may use and disclose PHI and describes patient rights under HIPAA.
The public Website, store, and general contact form are not substitutes for the patient portal. Do not submit sensitive medical information through a channel that the Practice has not designated for that purpose.
17. Website Availability and Accuracy
We work to provide useful and accurate information, but we do not promise that the Website will always be available, uninterrupted, secure, error-free, complete, or current. Website content may contain typographical, technical, medical, pricing, inventory, or other errors. We may correct or update content without notice.
Maintenance, third-party outages, internet conditions, cybersecurity events, device compatibility, and other circumstances may affect Website availability. You are responsible for maintaining appropriate devices, software, and internet access. We are not responsible for any delay or failure in Website availability or in fulfilling an accepted order to the extent caused by events beyond our reasonable control, including natural disasters, labor disputes, supplier or carrier failures, utility or network outages, cybersecurity incidents, or governmental actions.
18. Disclaimer of Website Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND ONLINE FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE PRACTICE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED.
This disclaimer applies to use of the Website and online store. It does not eliminate any express product warranty that cannot lawfully be disclaimed, and it does not alter the professional standard of care or legal duties applicable to medical services the Practice has agreed to provide.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ADVANCED DERMATOLOGY AND AESTHETIC MEDICINE, LLC AND ITS MEMBERS, MANAGERS, CLINICIANS, EMPLOYEES, CONTRACTORS, LICENSORS, AND WEBSITE SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ONLINE STORE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE PRACTICE AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE OR ONLINE STORE WILL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU PAID TO US THROUGH THE ONLINE STORE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100). THIS CAP DOES NOT APPLY TO ANY LIABILITY DESCRIBED IN THE FOLLOWING PARAGRAPH THAT CANNOT LAWFULLY BE LIMITED.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. In particular, these Terms do not waive or limit rights or responsibilities arising from professional medical care, gross negligence, willful misconduct, a defective product, or personal injury to the extent applicable law prohibits such a limitation.
20. Indemnification for Misuse
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Practice and its affiliates, personnel, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Website, your material violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from the Practice’s own conduct for which liability cannot lawfully be shifted.
21. Suspension and Termination
We may suspend or terminate your access to the Website or store features if we reasonably believe you have violated these Terms, engaged in fraud or abuse, threatened Website security, or created legal risk. Termination does not affect obligations associated with completed transactions or rights that must continue by their nature.
Suspension of Website access does not determine whether you may receive medical care from the Practice. Medical-services decisions are governed separately by professional obligations, applicable law, and Practice policies.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except to the extent another jurisdiction’s law must apply. Any dispute arising from the Website or online store that is not subject to a different binding agreement must be brought in a state or federal court with jurisdiction in Cook County, Illinois, unless applicable consumer law requires otherwise.
These Terms do not require arbitration and do not waive any right that cannot lawfully be waived.
23. Changes to These Terms
We may update these Terms to reflect changes in the Website, store, business practices, or legal requirements. We will post the revised Terms and update the “Last updated” date. Changes apply prospectively from the stated effective date unless applicable law permits otherwise.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms. Material changes may be communicated in another manner when required by law.
24. Severability, Waiver, and Entire Agreement
If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
These Terms, together with the policies and more specific terms incorporated by reference, constitute the agreement governing use of the Website and online store. They do not replace agreements or legal duties governing professional medical services.
